Supreme Court Ruling on US Patent Law
There was an interesting ruling today by the US Supreme Court on the application of patent law on products that have been sold. Today the Supreme Court ruled that after a product is sold, the patent owner cannot bring action against the buyers of said product. This case was relevant to Lexmark (the printer company) who had sought to limit the rights of its print cartridges to refill them. Read the full text of the opinion piece here . The ruling also stated that patent holder's rights are also exhausted when a product is exported from the USA. It will be interesting to see how this law will be interpreted in the Philippines.
