Declaration of Actual Use

Trademark Registration – Stage 3/4

Declaration of Actual Use & Issuance of certificate of trademark registration

After your trademark is approved, you must file documents with the IPOPHL to prove that you have a real product or service that supports your trademark filing.  This filing is called the Declaration of Actual Use (DAU).  We fill in a form for you, submit the form to the office in Manila, and include a few photos as proof.

The DAU needs to be renewed in a timely manner, according to the IPOPHL specifications.  Call us to see if you are needing Declaration of Actual Use help, as it can seem quite complicated.  Check our illustration below for a better understanding.

After the initial DAU final step is completed, the trademark office will issue your Certificate of Trademark Registration. We will then then send your certificate to you at no additional fee, to any address in the Philippines. (Beware many law firms charge extra fees just to send your certificate.) If you are outside the Philippines you can provide your courier tracking number, and we will ship it to you freight collect.
