TRADEMARK CLASS 7: Machines and Machine Tools; Motors and engines

In the Philippines, trademark law allows a business owner to register his or her trademark and protect it from infringement. Trademark registration is possible in the category in which the good or service falls. Different Trademark classes make it easier to recognize and register a Trademark in the right class to protect it against infringement, unauthorized or unlicensed use, sale, or production. In the Philippines, there are 45 different trademark classes.

Trademark Class 7

Trademark Class 7 of the Nice Classification includes machines, machine tools, power-operated tools; motors and engines, except for land vehicles; machine coupling and transmission components, except for land vehicles; agricultural implements, other than hand-operated hand tools; incubators for eggs; automatic vending machines.

Trademark Class 7 mainly includes the following goods:

  1. Parts of all kinds of motors and engines, for example, starters, mufflers, and cylinders for motors and engines.
  2. Electric cleaning and polishing apparatus, for example, electric shoe polishers, electric machines, and apparatus for carpet shampooing, and vacuum cleaners.
  3. 3D printers.
  4. Industrial robots.
  5. certain special vehicles not for transportation purposes, for example, road sweeping machines, road making machines, bulldozers, snowplows, as well as rubber tracks as parts of those vehicles’ crawlers.

Trademark registration under Class 7 can be obtained for any of these goods by filing an application with the Trademark Registrar.

What’s Not Included In Trademark Class 7?

The following goods are not covered under Class 7 of the Trademark Classification:

  1. Hand tools and implements, hand-operated (Class 8).
  2. Humanoid robots with artificial intelligence, laboratory robots, teaching robots, security surveillance robots (Class 9), surgical robots (Class 10), robotic cars (Class. 12), robotic drums (Class 15), toy robots (Class28).
  3. Motors and engines for land vehicles (Class 12).
  4. Treads for vehicles and tractors (Class 12).

Certain special machines, for example, automated teller machines (Class 9), respirators for artificial respiration (Class 10), refrigerating apparatus and machines (Class 11).
