TRADEMARK CLASS 13: Fireworks and Firearms

The Nice Classification, which was established by the Nice Agreement in 1957, divides marks into 45 different classes based on Goods and Services (Classes 1-34 for Goods and Classes 35-45 for Services). The purpose of these classifications is to allow users to seek trademark protection for goods or services in the classes that are most relevant to their business.

TM Class 13 includes firearms; ammunition and projectiles; explosives; and fireworks.

Why Should We Opt For TM Class 13?

You would choose Trademark Class 13 if you were registering any of these types of goods:

  • Air pistols (weapons)
  • Artillery guns (cannons)
  • Cleaning brushes for firearms
  • Explosive Cartridges
  • Flare pistols
  • Gun carriages (artillery)

You would not use Trademark Class 13 if you were registering for:

  1. Matches (Class 34– Tobacco Products)
  2. Beverages (Class 33– Alcoholic Beverages)
  3. Medicines (Class 5– Pharmaceuticals)

Related Classes

A related trademark class is related to another class; this is because the Indian Trademark Office (ITO) has determined that applicants registering in Class 13 are also eligible to register in these other classes.

Class 8– Hand tools and Implements, Class 7– Machines and Machines tools, Class 10– Surgical and Medical Instruments, Class 12– Vehicles and Vehicle Components, and Class 28– Games, Toys, and Sporting Games.

Trademark registration fees vary according to the class system as well. Each class of goods and services that you want to register requires a separate registration fee. For example, if you want to register a trademark in Class 5 for Pharmaceuticals and Class 10 for Dental Instruments and Apparatus, you must pay two separate fees.

When registering a trademark, it is critical to select the correct class; if you register a trademark in the incorrect class, you must restart the registration process from the beginning.
